Ex claims he's gonna take me to court LOL

So over 2 years ago, my ex got in contact with an English Bulldog breeder because he knew I wanted one...<br>he told me about it and that he wanted to get me one and I told him I wanted one but he didn't have to get one for me, he said "no, if it makes you happy, I'll get you one"<br>so he surprised me with one, and 4 months after we got her we broke up...he would even message my mom and then go tell his friends that he wanted to turn my family against me because I broke up with him...uh, maybe if you weren't physco crazy tryna pressure me into marrying you and move in with you at a young age we woulda stayed together! /end rant<br>Anyways, two years later and he said if I don't pay him back for Lyla he gonna take me to court...it's been TWO years. TWO. And on top, YOU bought her when you didn't have to, I even told you that you didn't have to and after we broke up I asked if you wanted her back and you said no. -________-<br>Plus, I pay her vet bills, her food, her toys, MY name is on her papers not YOURS...so technically, you have no control over her.<br>And on top, you really think a court is gonna take you seriously over a DOG...when I have all legal documents that she is mine and all vet bills and you are not nor have ever been on her papers or paid for a vet bill, nor have I ever asked you too.<br>This ain't some child support issue, this is a DOG YOU gave to ME...and told me I could KEEP...never said anything about payment until 6 months ago.<br>So please, do the court a favor and let people who have REAL issues go there...<br><br>Do you guys think I should pay him back or go to court?<br>And how do you guys think the court will take it?

    <br><br>Yea, I talked to a friend who works in the criminal justice field and knows several people within the legal field...<br>she said they would laugh at him and that he has no chance of winning with all the documents I have.

  • If your name is on her registration papers, you pay the vet bills and have been doing so for 2 years now you have all the evidence proving you are her owner. In another forum I'm on similar things have been brought up like this and from what I've gathered your ex really has no claim.

    <br><br>Yeah, I didn't think so.<br>I'm thinking about calling up the claims court and asking them about it.
  • Although law isn't exactly the same there, I'm pretty sure that a dog is considered property. When property is given as a gift the giver then no longer has any rights to it. If your ex took it to small claims court he would have to prove that you agreed that the money put out to purchase the dog was a loan and not a gift. The burden of proof would be on him, and with papers and you paying for the dog for almost two years AFTER you broke up all the evidence points to it being a gift not a loan. <br><br>Don't pay him back :P If he wants to drag it to court by all means oblige him. When you win he'll have to pay all the court costs :P I'd also bring any proof/witnesses of him trying to turn your family against you, since that proves that he's been doing things to try to get back at you for breaking up with him. Unfortunately I don't think any of what he did (that you told us of anyway) meets the burden for harassment or defamation or I'd say file a counter suit :P

  • As long as your name is on the papers then he has no claim. A friend had an issue kinda like yours. She won because she was the owner of the dog and could prove it by the vet papers, akc papers, and such

    <br><br>Thank you for your input.<br>What I don't understand is that his father has mounds of money...paying for his apartment, his 2k laptop, his 16k car, his schooling...and here I am trying to survive without my parents help and barley getting by so what does he need my money for? Just to be spiteful.<br>And on top of it all, he has his own job so while his parents pay for everything he gets to enjoy the luxury of having money.<br>I can see if my mom still has the message, I don't know everything it said my mom just said "he's crazy and needs to grow up" lol.<br>I don't THINK it's harassment...he texts me all the time about paying him back for Lyla, I usually ignore...I was gonna get my number changed but I'm afraid he would drag my mom into it again and she don't need that kinda stress.

    <br><br>Thank you, I was actually going to tell him this...<br>but if I did he'd prolly take me to court asap and he lives about 600+ miles away and it's not just a trip I can pick up and leave.<br>However, I don't think it would go through because of how dumb it is and he has no proof of anything.
