Wow. I can't even think of what to title this...

<span style="font-size:85">This is EXTREMELY LENGTHY & if you don't like stories of like "child abuse," you shouldn't read this...<br><br>About 2 1/2 years my cousin (Kyra) was "kidnapped" by her mom. And just so you know: Kyra is now 6 years old. SIX. Remember this throughout the story.<br><br>Her mom (Beth) & my uncle (Shawn) were never married, they were dating when they had Kyra & they broke up. Beth agreed that if Shawn let her keep the car, he could keep Kyra. First of all, what kind of parent trades a CAR for their CHILD?! Well, after about 3 months of them being broke up (Beth never once called Kyra during this time) Beth shows up and asks if Kyra could spend the night with her & her son (Andrew) & Shawn agreed (He's a really REALLY good guy) Well, she picked Kyra up on Friday and was supposed to bring Kyra home Saturday and she didn't. Shawn called & called & Beth never answered. Finally, Sunday, she calls & says that she's in UTAH with Kyra. Well, everything started happening with court & they ended up with joint custody but Beth got Physical Custody & every other year, they switch holidays (like one year, Shawn gets her for Christmas, next year, Beth gets her, etc etc) <br><br>Alright. Well. <br><br>Kyra came here in June. Beginning of June. (like the 8th or 9th) <br><br>Want to know what she came here with FOR THE ENTIRE SUMMER?<br><br>The clothes she was wearing (which consisted of jeans & a tshirt with NO UNDERWEAR)<br>Pair of shorts<br>Pair of jeans<br>Skirt<br>2 tshirts<br><br>That's it. FOR THE ENTIRE SUMMER. <br><br>Shawn had to wash the clothes TWICE to get all the dirt out of them.<br><br>Well, last week, Beth called Shawn & said now, instead of living in Texas (they moved there sometime within the last couple of months) they were living in Missouri. Why?<br><br>Beth lives in apartments for 2-3 months without paying rent & then moves out before she's evicted. Well, she got kicked out of her apartment & they were living in a hotel. They ran out of money for the hotel, so they started living in her car (it was her, her boyfriend & her new baby they had in March) [Andrew stays at his grandma's in the summer]. The car got Repo'd. So what did Beth do? <br><br>She picked up Andrew, got "only the things they need" and drove to Missouri to her boyfriend's friend's house (who she had never met). Want to know what they took? SOME stuff of Andrew's, Beth's stuffs, her boyfriend's stuff, & the baby stuff. Where's Kyra's stuff? Left at their house or the hotel. NONE of her clothes, NONE of her toys. NOTHING.<br><br>Well, Beth is now in Contempt of Court because in order for them to move, she has to give 90 days WRITTEN notice to Shawn. She didn't. So they're getting a paper Notorized that says Shawn can have Kyra for a year & on June 1, they'll have an assessment to see what's best for Kyra. In order for Beth to even be CONSIDERED, she has to hold down a job for 6 months & she has to be living in the same place for 6 months. [HA]<br><br>Well, my Uncle wrote a letter to the Judge & told him EVERYTHING. (He sent it Friday & we're hoping to hear from him soon) <br><br>& this part right here...this part completely TOTALLY broke my heart:<br><br>First of all, like I said, Kyra is SIX. <br><br>She said her mom screams at her and tells her she hates her. Wow. Six year olds aren't even supposed to know what hate is...<br><br>Secondly (this part makes me cry just thinking about it)<br><br>This is a conversation between myself & Kyra<br><br>Me: Are you excited about going to school here?<br>Kyra: Yes. But cousin Tia, can you promise me something?<br>Me: Hmm?<br>Kyra: (as she's crying) can you promise that while I'm in school, you won't sell all my toys?<br>Me: What do you mean?<br>Kyra: When I went to Kindergarten, my mom sold all my toys while I was gone and when I came home, I had NO toys. <br>Me: Kyra, honey, I would never sell your toys. <br><br>Dude.<br><br>This just pisses me off to no end. -.-<br><br>I sure hope my Uncle gets custody of Kyra. >.><br><br></span>

  • <span style="font-size:85">Paige-<br>Yeah, we're all hoping Shawn gets Kyra. The poor little kid has moved so many times these past two years (3 states & 30 different apartments) I just hope we hear from the judge soon and they get the paper notarized soon.</span>

I wish the judge can just "shadow" Kyra and actually see her life<br>rather then just read words on a paper saying things about her life. When she first got here, she gorged herself on food because she said she was afraid we would run out like her mom...<br><br>She's just recently been opening up about her mom and stuff<br><br>Like, Kyra made straight A's in Kindergarten, she's a pretty intelligent child. She said her mom never told her good job for getting good grades because "you're supposed to do good in school" The poor kid</span>

  • I hope so too, from the sounds of it she is much better off with her father. Unfortunately, a lot of rulings favor to the mother. Which I hope is not the case here. <br><br>I hope everything works out, no child should have to go through this.
  • <span style="font-size:85">Wow,this is just -wrong-, she should NOT have gone to Beth in the first place. :/<br>I know someone who was gonna get married but the girl left him and now she has another kid, and my friend is fighting for custody,the kid is TWO and he used to go stay with his dad a few days out of a week but now the court has it where every other week he is with the dad and the other weeks with his mom. This is just going to mess up the kid even more! So my friend is fighting for full custody of his boy, which I think he should get it cause the mom moves ALL the time and she is now with a druggy. </span>

  • You know one thing I hope that comes out of this? Everyone who is posting on or reading this, if they are ever unfortunate enough to have a child with someone they break up with or divorce, that they remember the child's well being first, even if it means the child stays with their other parent most of the time. Too many times, a child is used as leverage against the other parent, rather than either parent trying to see what's best for the child. Or a parent or both parents seem to think they are the only one capable of caring for the child when that might not be true. Please, if this happens to you, set aside your hurt and/or hatred of the other person long enough to really look at what is best for your children, not for you and not what might hurt the other person the most.<br><br>Something I would suggest your uncle checking into, Darkness, is seeing if the judge would appoint a guardian ad litum (legal representative) for Kyra. If the mother is as bad as it seems, it can only help if Kyra has her own lawyer backing up what your uncle is saying. I know when my ex attempted to take custody of my oldest away from me, this was something that was done for her and was probably the "nail in the coffin" for my ex's accusations and case. <br><br>My daughter's lawyer did not suggest removing custody from me as it would do no benefit and might possibly do harm for her because of the reasons my ex wanted sole custody. She also acted as a person who got to the bottom of the issue by interviewing my ex, our daughter and I separately and then together and she discovered the case was basically about my ex trying to go on a power trip because I wouldn't tell him if or who I was dating a full year after our divorce was final. Nor would I give him personal information about my employer or the person I was renting a house from or any of my friends. He wanted to be the one to decide whether or not I was "behaving appropriately" enough for my daughter to stay with me.<br><br>Good luck to your uncle and I hope things turn out the best for Kyra

Due to Beth being in contempt of court, the judge said the thing about my uncle keeping Kyra for a year while Beth tries to get a job and a stable environment. In June, when they have to meet to figure out what's best for Kyra, they were planning on getting a guardian ad litum, just to figure out the best possible thing for Kyra. <br><br>My uncle has no problem sending Kyra to see her mom, the only stipulation with that is that Beth would have to pay for Kyra's flight [before all this happened and they had joint custody, if Shawn wanted to see Kyra, he'd have to pay for the plane ticket, so the judge said that rule still applies to Beth] <br><br>I don't hate Beth, I hate what she's done but not her as a person. Even though Beth now has three kids, I think she has some growing up to do. Shawn doesn't want to take Kyra completely away from Beth, he just wants her to be in a more stable environment.<br><br><br>When she first got here, she would throw temper tantrums, scream, everything if she didn't get her way...we've finally got her settled down and she actually talks like a six year old and not like a baby throwing a fit. <br><br>I understand everything you're completely saying, Bama and I agree with you...I would prefer my uncle to get Kyra HOWEVER, if Beth does happen to settle down and everything, I just want the best for Kyra because the way things were going, she wasn't growing up the way a child should.</span>
